What is an EU Authorized Representative and why do you need one?

The EU AI Act does not just regulate what AI systems do. It regulates who is legally accountable for them within the European Union. For companies based outside the EU, that accountability cannot sit with the provider alone. European regulators need a legal entity they can reach, audit, and hold responsible on EU soil. That legal entity is the EU Authorized Representative.

What an Authorized Representative is

A legal party established within the European Union that acts as the official contact point between a non-EU AI provider and European competent authorities. Once appointed, the representative carries regulatory liability, holds required documentation, and handles authority communications on behalf of the provider.

What it is not

An Authorized Representative is not a mailbox service, a registered address, or a legal advisory arrangement. It is a substantive legal function with direct enforcement consequences. The representative can be audited, fined, and held liable.

When is an Authorized Representative mandatory?

An Authorized Representative is mandatory for every non-EU provider placing AI systems or general-purpose AI models on the European market.

Article 22 of the EU AI Act requires non-EU providers placing AI systems on the European market to appoint an Authorized Representative established in the Union. Article 54 extends this obligation to providers of general-purpose AI models.

If your AI system or model is available to users in the EU and you are not established in the EU, you are required to appoint an Authorized Representative before placing it on the market.

Art. 22 & 54 AI Act

Non-EU providers placing AI systems on the European market must appoint an EU Authorized Representative established in the Union before market placement. Article 54 extends this obligation to providers of general-purpose AI models. There are no exceptions based on company size or revenue. This is the role AI Distribution fulfills.

If you are incorporated outside the European Union, Article 22 applies if any of the following is true.

You develop or distribute AI systems used by European customers
You provide a general-purpose AI model accessible within the EU
Your AI is embedded in products or platforms available in European markets
